Rights & Responsibilities During an OSHA Inspection

Both presenters will give a perspective on the inspection from the side of the inspector and the owner/contractor/sub/operator.

Chad will cover the following topics: 

  • The OSHA inspection process including what to expect, how we get onsite, what happens during an inspection and what happens if there are citations
  • Employee/employer rights and responsibilities during inspections
  • Types of OSHA inspections such as complaints, accidents, referrals
  • Types of violations and penalties

Pat will cover the following topics: 

  • What are the unique aspects of an OSHA inspection?
  • When can OSHA inspect a work area?
  • Can OSHA cite an employer when its own employees are not exposed?
  • Should you cooperate or confront the inspector?
  • Does OSHA need a subpoena to inspect?
  • What rights does an employer have during an OSHA inspection?
  • What rights does OSHA have to interview employees?
  • What documents does OSHA want to review?
  • Do such documents need to be produced immediately?
